Guarantee Advice
Banks, financial institutions and other third parties may require a person to obtain independent legal advice regarding the person's obligations under a personal guarantee.
What do you need to do to obtain independent legal advice?
-
Provide your solicitor with a copy of the guarantee documents, as well as any documents relating to the borrowing or other arrangement prior to the meeting.
-
Bring proper identification to your meeting - your driver licence and a valid passport is preferred. If you don't have both of these documents, other documents include your Medicare card or credit card.
-
Be prepared to listen to the advice and consider issues raised by the solicitor as to risk and effect.
