Guarantee Advice

Banks, financial institutions and other third parties may require a person to obtain independent legal advice regarding the person's obligations under a personal guarantee. 

What do you need to do to obtain independent legal advice?

  1. Provide your solicitor with a copy of the guarantee documents, as well as any documents relating to the borrowing or other arrangement prior to the meeting.

  2. Bring proper identification to your meeting - your driver licence and a valid passport is preferred. If you don't have both of these documents, other documents include your Medicare card or credit card.

  3. Be prepared to listen to the advice and consider issues raised by the solicitor as to risk and effect.
